HIPAA says distributing infant formula discharge bags is a form of marketing. It drags down hospital scores on the CDC’s mPINC survey. Without inventory controls, there’s no way for a hospital to inform a patient about a recall on the formula (which has happened). What happens if an infant is sickened by the formula in the bag (which has happened)? Are you and the hospital liable for this formula giveaway? We’ll see in this presentation.
